The new regulation introduces the <strong>obligation to engage in an Appropriate Dispute Resolution Mechanism (ADR\/MASC)<\/strong> in many procedures, with <strong>mediation<\/strong> standing out as a fast, effective and human-centred option.<\/p>\n<p>More and more individuals, families, homeowners\u2019 associations and organisations of all kinds are discovering that consulting a <strong>professional mediator<\/strong> before initiating court proceedings is not only a legal requirement in many cases \u2014 it is also the smartest way to resolve conflicts without turning them into a judicial confrontation.<\/p>\n<p>The key question remains: <strong>Is it worth going to mediation before going to court?<\/strong><br \/>\nIn the vast majority of situations, the answer is <strong>yes<\/strong>. Here\u2019s why.<\/p>\n<ol>\n<li><strong> Mediation vs. Litigation: a real comparison of costs, timeframes and emotional impact<\/strong><\/li>\n<\/ol>\n<p><strong>Economic Costs<\/strong><\/p>\n<ul>\n<li><strong> Mediation:<\/strong><br \/>\nThe price typically ranges from <strong>50 to 150 euros per session<\/strong>, depending on the complexity of the case and the number of people involved. Most disputes are resolved in <strong>two to four sessions<\/strong>, meaning the overall cost is low.<br \/>\nCosts are usually shared between the parties, and there is <strong>no risk of being ordered to pay legal costs<\/strong>, which further reduces the financial burden.<\/li>\n<li><strong> Litigation:<\/strong><br \/>\nA civil court case can cost between <strong>2,000 and 10,000 euros<\/strong>, taking into account lawyers\u2019 fees, court representatives, experts and potential appeals.<br \/>\nAdded to this is the risk of being <strong>ordered to pay the opposing party\u2019s legal costs<\/strong>, which can double or triple the initial investment.<br \/>\nIn short, litigation can be <strong>five to twenty times more expensive<\/strong> than mediation.<\/li>\n<\/ul>\n<p><strong>Resolution Times<\/strong><\/p>\n<ul>\n<li><strong> Mediation:<\/strong><br \/>\nMost disputes can be resolved within <strong>two weeks to two months<\/strong>, thanks to flexible scheduling and the absence of bureaucratic delays.<\/li>\n<li><strong> Litigation:<\/strong><br \/>\nA civil case usually takes <strong>one to three years<\/strong>. reference)<\/em><\/p>\n<p>Mediation is not allowed in cases involving:<\/p>\n<ul>\n<li><strong>Gender-based or domestic violence<\/strong>, when there is evidence or an open case.<\/li>\n<li><strong>Non-disposable rights<\/strong>, such as civil status, parentage, legal capacity or matters affecting minors.<\/li>\n<li><strong>Criminal proceedings<\/strong>, except in regulated restorative justice programmes.<\/li>\n<li><strong>Administrative matters<\/strong> where the public administration cannot negotiate.<\/li>\n<li><strong>Situations involving abuse,
