The threat of an indefinite strike only worsens a situation long denounced by legal professionals: <strong>court collapse<\/strong> and growing <strong>disaffection<\/strong> among judicial staff.<\/p>\n<p><strong>Why are judges and prosecutors going on strike?<\/strong><\/p>\n<p>The associations \u2014<strong>APM, AJFV, FJI, AF and APIF<\/strong>\u2014 warn that recent government reforms regarding <strong>access to the judiciary and the public prosecutor\u2019s office<\/strong> and <strong>the Prosecutor General\u2019s statute<\/strong> threaten <strong>judicial independence<\/strong>, lower <strong>standards of merit and ability<\/strong>, and place <strong>excessive power in the hands of the State Prosecutor General<\/strong>.<\/p>\n<p>They also denounce the <strong>lack of dialogue<\/strong> with the Ministry of Justice and a reform policy carried out <strong>without consensus<\/strong>. Although the <strong>right to strike for judges and prosecutors<\/strong> is not clearly recognized in Spanish law, similar protests have occurred before, with mixed results but always a <strong>significant impact on the functioning of the judiciary<\/strong>.<\/p>\n<p><strong>A justice system under constant pressure<\/strong><\/p>\n<p>Spain has been dealing with a <strong>structural collapse<\/strong> of its justice system for years. Their aim is not to replace traditional justice but to <strong>complement<\/strong> it and reshape how we handle disputes.<\/p>\n<p>Some key benefits include:<\/p>\n<ul>\n<li>\u2705 <strong>Speed<\/strong>: a conflict that could take years in court can be resolved in weeks or even days through mediation.<\/li>\n<li>\u2705 <strong>Lower costs<\/strong>: compared to high litigation expenses, ADR tends to be more affordable.<\/li>\n<li>\u2705 <strong>Empowerment of parties<\/strong>: those involved design their own agreement, increasing compliance and satisfaction.<\/li>\n<li>\u2705 <strong>Preservation of relationships<\/strong>: especially valuable in family, community, business or workplace disputes where continued contact is inevitable.<\/li>\n<li>\u2705 <strong>Confidentiality and flexibility<\/strong>: the process adapts to the needs and expectations of the parties.<\/li>\n<\/ul>\n<p><strong>A chance to rethink access to justice<\/strong><\/p>\n<p>The court strike, beyond its immediate consequences, invites us to reflect on <strong>what kind of justice system we want<\/strong>.
